Who do I sue if my Uber driver is in an accident and I am injured?

Just in case you are looking for a simple yes or no or this or that answer on this one, then this is the wrong question because there are so many complications and scenarios to this so the best and shortest answer you can get is, it’s complicated, or it depends.

Uber has made transportation very comfortable and easy too. You can hire a car in few minutes and you would be right on your way. Unfortunately, with so many cars everywhere, this means there are going to be more accidents with the Uber tags on it. Many people are beginning to wonder who they will be suing if by any chance they have an accident in an Uber ride or worse still people who have been in accidents in Uber rides want to know who to sue, the company or the driver. As earlier stated, it depends. Questions have been arising like, who is responsible for compensating the passenger and the customer, Uber or the driver? Or situations like if you are driving your car and an Uber vehicle hits yours, who is going to pay for the damages Uber or the driver?

It is possible that Uber could pay, it is possible that’s the driver could pay and there are even cases where both are liable to pay for the damages and you should also know that you can also lose the case. Uber has an insurance program of three parts for their drivers. So basically who pays for the damages depends on the exact situation. If you get in an accident involving Uber and you want to sue, you should get a good injury lawyer who will help you file a proper claim. Here are some scenarios to know who to sue

The Uber driver having is app off or off duty

In this case, the driver is not living as an Uber partner but as a person. Their app isn’t active and they are not working an active gate and if this is the case, they are not covered by the Uber driver-partner insurance. If this is the case, you will be suing the individual or you would be suing their personal auto insurance but this totally has nothing to do with Uber.

Uber app is on and Uber driving is actively awaiting a request

In this scenario, you would be suing Uber or you can sue the driver who is covered with the Uber contingent liability insurance and the driver’s personal auto insurance. If by any means the accident was caused by the driver the insurance covers things like repair and if very bad replacement of the property that was damaged as well as reimbursement for medical bills. Uber will cover whatever the individual insurance does not cover but this time with limitations. The contingent coverage offered by Uber includes

1 person  at $50,000

$100,000 per accident for bodily injury

For accident and damage of property, $25,000

Uber app is on and the driver is actively on his way to pick up a passenger

In this scenario, Uber provided quite a lot of insurance coverage and this includes a $1,000,000 in Liability Coverage Per Accident, If there are any medical bills, they are sorted by this insurance. It also pays for the cost of the bills due to property damage. $1,000,000 in Uninsured/Underinsured Coverage

In this case, the drivers are usually uninsured or underinsured. It is also in play if the accident was caused by another driver and not the Uber driver himself. This insurances covers both the Uber driver and the passengers too. It is usually in play when the other driver isn’t found.

However, it is not as easy as above. Uber drivers are not employees but they are independent contractors and they sign a contract before the job which states that Uber will not take any responsibility for any passenger or pedestrian accident. It also has in its agreement that as a passenger you cannot hold Uber responsible for your loss on a trip. You see it is not as straight forward as you think.…

Everyone is trying to make a few more dollars from what ever they do and some people don’t mind going the extra mile to do that. The locksmith business has been infiltrated and one has to be careful about who they are hiring to do their lockSmith job. Locking yourself out of your own house of losing your keys can be very embarrassing and it can take a while before u even come out of the whole thing inky to find out the keys have been lost and you would be needing a locksmith.

LOCKSMITH

The best locksmiths are usually people that works on door locks and helps people who lose their keys or lock themselves out of the house. Calling a blacksmith can be a bit risky because except they are the blacksmith you have been working with for a while, it is more like inviting a total Stranger to your home. Most times it is better to hire a service or company than to hire just one locksmith. There are locksmith scams going on right now and they used these schemes and formats to rid people off good sum of money. One needs to be vigilant but the most important thing is do you really have to be a victim before u learn. Of course not. In this article we are going to be showing you how to identify a locksmith scam before they even know you already know.

THE FORMAT

Before we go into the identification we need to go into the format. You need to know how the locksmith scam actually works so when you finally meet one, and they start going down this lane, you know this is one of them.

1. THE COMPANY YOU CAN FIND EVERYWHERE BUT ISN’T REAL

They can go as far as putting the fake company on Google so it can add some more truth to the fact that they are legit. This should not change a thing to you. They could even own a website and use social media marketing strategies to find customers like you. It could not even be a Company but one random guy operating his laptop from his room. They could even have reviews and testimonial, all these can be imputed by any individual. Do not be moved by this. Until the job is finished and done, do not trust anything you see.

2. THE CALL

Once you make contact, they would do everything to Make you believe they are real, so as you read you need to understand that you need to be very vigilant as you intend making any call to any blacksmith, whether it is existing or an old one. Most times, the number you call might not be in the United States and they possible be in a country based outside of the United States. The locksmith however is in the United States and they say they are going to be sending you one to your location.

3. THE PRICE

This is the hook. It’s usually a price that no locksmith will work for. It is almost totally unbelievable and if you don’t know anything about this you probably would be thinking you are just about to have a great day. You both agree and they come over to get the job done. When they the locksmith or rather, fake locksmith arrive, they begin work and after a few minutes that act like they have found something terribly wrong and they wouldn’t have a choice than to drill the lock, and after drilling you would just have to by a new one. Now you need a new lock and you need to pay the locksmith. The bill just went higher and not by a little ratio but substantially. After you had to get a new lock he does the job and says he can’t take the same price that was bargained on the phone, they will talk about how tedious the job was and how you saw everything and they would end up charging up to 5 times or even 10times the bargained amount. It works for them most times.…

Abboriginal Tech

Stripping Away Immigration Issues in IT

At D-Hive we are on a mission to bring together digital innovation in the IT sector and social innovation in the communities of aboriginal peoples in Australia.

This year we have placed nearly 500 ex tribesmen and Aboriginal and Torres Strait Islander people with jobs in the IT companies and digital tech startups in Victoria, Queensland and New South Wales. About 45% of the placements were unemployed and had been in various states of job searching for anywhere between 1-4 years. 25-30% of the placements came from university dropout status or school leavers who had not graduated with enough points in their grade system to qualify for jobs before they took the necessary tests that were provided by D-Hive sponsors. One of the sponsors is malestrippers.com.au who not only help support the D-Hive foundation financially but actually also decided to employ two of the placements into their entertainment group who tour around Brisbane and North Sydney throughout the Summer and into the Autumn.

The placements have all managed to pass their probation periods in the jobs. They are all continuing to study a range of different tech related topics from php coding, java script, c++ and magneto. We have web developers and server side assistants who are all working hard at understanding what is essentially a new language to anyone who hasn’t been studying it for long time.

We are now entering the next round of searches for new participants in the program and are specifically looking for anyone from a middle east background who may have fled the challenges in the war torn regions of Libya and Somalia in Africa over the last 5 years and arrives in Australia as a refugee. If you know of anyone that would appreciate a shot at working in the IT industry then please reach out to us.…
